Perpetual Beverages Privacy Policy

Effective Date: July 18, 2026

This Privacy Policy explains how Perpetual Beverages LLC, doing business as Perpetual Beverages (“Perpetual Beverages,” “we,” “us,” or “our”), collects, uses, discloses, and protects personal information in connection with our website, web application, customer accounts, keg delivery services, keg fridge and equipment rental services, event rentals, beverage ordering, delivery, and related services (collectively, the “Services”).

This Privacy Policy is intended for customers and users located in the United States, and initially for customers receiving service in the San Diego, California area. If you have questions, contact us at privacy@perpetualbeverages.com.


1. Scope of This Privacy Policy

This Privacy Policy applies to personal information we collect when you:

  • visit our website or use our web application;
  • create or use an account;
  • join a waitlist or request information;
  • place or manage beverage, delivery, subscription, rental, or event orders;
  • use the Club, Drop, Occasion, or Never Run Out offerings;
  • communicate with us;
  • receive deliveries, pickups, installations, maintenance, or equipment services;
  • interact with our connected keg-monitoring devices; or
  • otherwise use the Services.

This Privacy Policy does not apply to websites, services, or privacy practices of third parties that we do not own or control, including payment processors, authentication providers, hosting providers, analytics providers, communications providers, breweries, licensed alcohol retailers, or other third parties that may have their own privacy policies.


2. Personal Information We Collect

We collect the following categories of personal information, depending on how you use the Services.

A. Account and Identity Information

We may collect:

  • email address;
  • password or account credential information;
  • full name;
  • company legal name and display name, if applicable;
  • account role;
  • phone number;
  • ZIP code;
  • serviceable-area information;
  • age-related information, including date of birth where needed to determine eligibility for alcohol ordering;
  • alcohol-exclusion or non-alcoholic-only preference;
  • terms-of-service and privacy-policy acceptance records, including timestamp, IP address, user-agent, and terms version.

B. Waitlist and Marketing Interest Information

If you join a waitlist or request information, we may collect:

  • email address;
  • ZIP code;
  • site type, such as home, office, venue, or other location type;
  • plan preference;
  • beverage preferences;
  • open-ended comments or notes you provide;
  • timestamp;
  • IP address;
  • browser, device, or user-agent information.

C. Delivery, Site, and Access Information

To deliver, install, maintain, pick up, or service kegs and equipment, we may collect:

  • delivery address, including street address, city, state, postal code, and country;
  • site address and service location details;
  • access notes, including door codes, gate codes, entry instructions, building or reception information, stairs, multiple-location details, and delivery-route instructions;
  • primary and secondary on-site contact names, phone numbers, and email addresses;
  • delivery-window selections;
  • order notes and free-text instructions;
  • recipient name at delivery;
  • delivery confirmation information;
  • delivery signature images;
  • condition photos at drop-off, pickup, installation, return, or inspection;
  • installer photos and signatures;
  • delivery failure, rescheduling, or pickup information.

Please do not provide sensitive access information unless it is necessary for delivery or service. You are responsible for ensuring that any access notes you provide are accurate and authorized.

D. Order, Subscription, Rental, and Transaction Information

We may collect:

  • plan selection, including Club, Drop, Occasion, and any add-ons;
  • beverage selections and preferences;
  • product details, including whether a product is alcoholic or non-alcoholic;
  • order history;
  • delivery, pickup, installation, cleaning, and maintenance history;
  • subscription status;
  • Never Run Out enrollment and replenishment history;
  • cancellation, pause, skip, reschedule, or modification history;
  • fees, deposits, authorization holds, charges, refunds, and credits;
  • equipment assignment, return, damage, loss, and replacement information;
  • customer service and dispute records.

E. Payment Information

Payments are processed by our third-party payment processor, currently Stripe. We do not store full payment card numbers on our systems.

We may receive and store limited payment-related information, such as:

  • card brand;
  • last four digits;
  • expiration month and year;
  • funding type, where available;
  • payment processor customer or payment-method identifiers;
  • transaction amounts, dates, taxes, fees, deposits, refunds, and charge status;
  • payment failure and retry information;
  • mandate or authorization consent records, including timestamp, IP address, user-agent, and terms version.

Stripe may collect full card number, CVC, billing details, and fraud-prevention or device information directly under its own terms and privacy practices.

F. Age Verification and Alcohol Delivery Information

For orders involving alcoholic beverages, we may collect:

  • date of birth entered during age-gating;
  • confirmation that a recipient appeared to be 21 years of age or older;
  • recipient name;
  • delivery-age-verification notes;
  • government-photo-ID verification confirmation;
  • delivery signature;
  • delivery refusal or failed-delivery information;
  • information needed to comply with alcohol laws, audit obligations, and licensed retailer requirements.

Currently, age verification at delivery is performed through a visual check of a valid government-issued photo ID. We do not scan, copy, photograph, or store images of government IDs or the data fields they contain, and we do not collect more information from a government ID than is necessary to verify eligibility and complete the delivery. If we later implement ID scanning, we will update this Privacy Policy to describe what is collected.

G. Connected Device and Consumption Information

For Club customers and any other customers using our connected keg-monitoring equipment, we may collect device and usage information, including:

  • keg weight readings;
  • calibration values;
  • derived fill level or percentage remaining;
  • estimated glasses remaining;
  • consumption analytics, such as ounces dispensed, pour patterns, time of use, and depletion forecasts;
  • device ID;
  • firmware version;
  • operating mode;
  • offline flag;
  • device health information;
  • free memory or diagnostic status;
  • restart or boot diagnostics, reset reason, uptime, and timestamps.

The keg-monitoring device does not collect audio, video, images, biometric data, precise geolocation, or information from the beverage itself. The device is placed under each keg inside the kegerator or keg system and is used to support service operations, equipment management, fill-level visibility, and optional automatic replenishment.

H. WiFi Credentials for Device Setup

For some Club installations, you may provide WiFi network credentials so the connected scale can connect to your network.

Based on current technical design, the WiFi password is entered during installation and transmitted locally from the installer device to the scale over Bluetooth Low Energy. It is not sent to, processed by, or stored on Perpetual Beverages’ servers or databases. The password is stored only on the scale, encrypted at rest using device-level protections, and cannot be read back, displayed, or logged after setup. The installer application holds the password only temporarily during the active installation session and does not write it to persistent storage.

You may request a WiFi reset or factory reset to erase the credentials from the scale. We also perform a factory reset when a device is returned to us.

I. Website, App, Device, and Log Information

When you visit our website or use the web application, we may collect:

  • IP address;
  • approximate city, region, or country derived from IP address;
  • browser type;
  • device type;
  • operating system;
  • user-agent;
  • pages viewed;
  • on-site events;
  • referring and exit pages;
  • login and signup records;
  • timestamps;
  • diagnostic, security, and error logs.

Anonymous website visitors may be tracked by IP address, user-agent, and event activity.


3. Sources of Personal Information

We collect personal information from:

  • you, when you create an account, join a waitlist, place an order, provide access notes, communicate with us, or use the Services;
  • your interactions with our website, web application, emails, and connected equipment;
  • our delivery, installation, service, and customer-support personnel;
  • payment processors;
  • hosting, analytics, authentication, communications, and infrastructure providers;
  • licensed alcohol retailers, breweries, or merchant of records involved in regulated alcohol sales or fulfillment;
  • service providers that help us detect fraud, operate our systems, or support compliance.

4. How We Use Personal Information

We use personal information for the following purposes:

A. To Provide and Operate the Services

We use personal information to:

  • create and manage accounts;
  • confirm serviceable ZIP codes;
  • process orders;
  • schedule deliveries, pickups, installations, maintenance, cleaning, and equipment removal;
  • provide Club, Drop, Occasion, and Never Run Out services;
  • manage subscriptions, rentals, deposits, holds, charges, refunds, and credits;
  • provide fill-level information and depletion forecasts;
  • trigger opt-in Never Run Out replenishment;
  • communicate about orders, deliveries, pickups, payment issues, service changes, and account activity;
  • provide customer support.

B. To Process Payments and Manage Billing

We use payment-related information to:

  • process charges through our payment processor;
  • maintain a payment method on file where required for the Services;
  • charge recurring subscription fees;
  • process opt-in automatic replenishment charges;
  • apply deposits, authorization holds, damage charges, replacement charges, late fees, cancellation fees, taxes, and refunds;
  • generate receipts and invoices;
  • manage payment failures and retries.

C. To Verify Eligibility and Comply With Alcohol Requirements

We use age-verification and delivery information to:

  • determine whether a user is eligible to order alcoholic products;
  • route under-21 or alcohol-excluded users to non-alcoholic products;
  • verify that alcohol deliveries are accepted only by an eligible adult 21 or older with valid government-issued photo ID;
  • refuse delivery where required;
  • comply with applicable California alcoholic-beverage laws, audit requirements, and licensed retailer obligations;
  • maintain required alcohol order and delivery records.

D. To Manage Equipment, Safety, and Site Access

We use personal information to:

  • deliver, install, inspect, maintain, clean, repair, replace, and recover equipment;
  • document equipment condition;
  • confirm customer responsibility for equipment and kegs;
  • manage access to homes, offices, venues, and other sites;
  • protect delivery and service personnel;
  • investigate damage, loss, misuse, tampering, or safety issues.

E. To Communicate With You

We may use contact information to send:

  • account and security messages;
  • order confirmations;
  • delivery and pickup reminders;
  • automatic replenishment notices;
  • receipts and invoices;
  • payment failure and dunning notices;
  • service updates;
  • customer-support responses;
  • legal notices;
  • marketing emails, if permitted by law and your preferences;
  • text messages relating to delivery scheduling or service logistics, if you provide consent.

You may opt out of marketing communications as described below. You cannot opt out of transactional or service-related messages that are necessary to provide the Services.

F. For Analytics, Improvement, and Forecasting

We may use personal information and aggregated or de-identified information to:

  • understand service demand;
  • forecast consumption and replenishment timing;
  • improve delivery scheduling;
  • improve product availability;
  • analyze beverage preferences;
  • evaluate service regions and rollout plans;
  • improve website and app functionality;
  • detect and troubleshoot errors.

G. For Security, Fraud Prevention, and Legal Compliance

We may use personal information to:

  • secure accounts;
  • monitor login and signup activity;
  • detect fraud, abuse, or unauthorized access;
  • enforce our Terms of Service;
  • protect our rights, personnel, customers, equipment, and business;
  • comply with legal, tax, accounting, alcohol, regulatory, audit, insurance, and dispute-resolution obligations.

5. Cookies, Analytics, and Tracking Technologies

We and our service providers may use cookies, pixels, analytics tools, logs, and similar technologies to operate and improve the website and web application.

Perpetual Beverages uses Vercel Analytics and related hosting analytics. These tools may collect information such as IP address, user-agent, approximate geolocation, page views, and on-site events.

We do not currently state that we sell personal information or share personal information for cross-context behavioral advertising. If we later use advertising pixels, retargeting tools, third-party ad networks, or similar technologies, we will update this Privacy Policy and provide any legally required notices and choices.

You may be able to control cookies through your browser settings. If you disable cookies or similar technologies, some parts of the Services may not function properly.

Do Not Track. Some browsers offer a "Do Not Track" ("DNT") setting that sends a signal to websites you visit. There is no common industry or legal standard for recognizing or honoring DNT signals. Because no uniform standard has been adopted, our website does not currently respond to or alter its practices in response to DNT signals. We do not authorize third parties to collect personally identifiable information about your online activities over time and across different websites when you use the Services. If we adopt a process for responding to DNT signals in the future, we will describe it in this Privacy Policy.


6. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients.

A. Service Providers and Vendors

We disclose personal information to vendors that help us operate the Services, such as:

  • hosting and cloud infrastructure providers;
  • database and backend compute providers;
  • website and app hosting providers;
  • analytics providers;
  • payment processors;
  • authentication providers;
  • email and communications providers;
  • text-message providers;
  • cloud storage providers;
  • IoT platform providers;
  • customer-support, security, fraud-prevention, and compliance providers.

Current and planned vendors may include Stripe, Vercel, Railway, Neon, Render, AWS, Auth0, Twilio, ip-api.com (IP geolocation lookup), Redis or successor caching/database systems, and other vendors that support similar functions. Beverage retailers and fulfillment vendors may include alcohol vendors such as Pure Project and AleSmith, and non-alcohol vendors such as Superfood Company, California Roasting Collective, and Steady State Roasting. Vendor use may change over time as our systems evolve.

We require these service providers and vendors to use personal information only to provide services to Perpetual Beverages and not for their own independent purposes, except as otherwise described in this Privacy Policy, including in Section 6.B (Payment Processors and Licensed Retailers/Merchants of Record) and Section 6.F (Aggregated or De-Identified Information).

B. Payment Processors and Licensed Retailers/Merchants of Record

We disclose payment and transaction information to Stripe and, where applicable, any retailer licensed by the California Department of Alcoholic Beverage Control (“ABC”) and/or applicable licensed seller/merchant of record, breweries, or other vendors involved in alcohol sales, payment settlement, regulatory compliance, or audit obligations.

Alcoholic beverages available through the platform may be sold by a licensed California ABC retailer and/or applicable licensed seller/merchant of record, or by breweries acting as merchant of record, and not by Perpetual Beverages. Because these retailers act as the seller or merchant of record rather than solely as our service providers, they may receive and use certain order, payment, and customer information for their own legal, settlement, regulatory, alcohol-compliance, and audit obligations.

C. Delivery, Installation, and Service Personnel

We disclose information to personnel and contractors who need it to provide delivery, pickup, installation, maintenance, cleaning, inspection, equipment recovery, and related services.

D. Legal, Compliance, and Safety Disclosures

We may disclose personal information if we believe doing so is necessary or appropriate to:

  • comply with law, regulation, subpoena, audit, or legal process;
  • comply with alcohol, tax, accounting, or payment obligations;
  • respond to government, regulatory, law-enforcement, or California ABC requests;
  • enforce our Terms of Service;
  • protect the rights, property, or safety of Perpetual Beverages, customers, delivery personnel, vendors, retailers, or others;
  • investigate fraud, abuse, security incidents, unlawful activity, or equipment misuse.

E. Business Transfers

We may disclose or transfer personal information in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar business transaction.

F. Aggregated or De-Identified Information

We may use and disclose aggregated, anonymized, or de-identified information that does not reasonably identify you. For example, we may share aggregated consumption patterns, ZIP-code-level demand, office/home service trends, or beverage preference data with vendors, suppliers, breweries, retailers, partners, or prospective partners. Where we maintain de-identified information, we will maintain and use it only in de-identified form, will not attempt to reidentify it except as permitted by law, and will contractually obligate recipients to comply with the same restrictions.


7. Sensitive Personal Information

Depending on your use of the Services, we may collect information that some laws classify as sensitive, such as account login credentials, precise site access information, age-verification information, and information concerning alcohol eligibility. We use this information to provide the Services, verify eligibility, secure accounts, fulfill legal obligations, and protect safety.

We do not use or disclose sensitive personal information for purposes that would require a right to limit use under California law unless we provide the required notice and choice.


8. Sale, Sharing, Targeted Advertising, and Profiling

We do not currently sell personal information or share personal information for cross-context behavioral advertising. We also do not currently disclose personal information to third-party advertising networks for targeted advertising.

We may use information such as order history, beverage preferences, and service activity to personalize our own in-app and email communications, recommend products, and send offers, subject to your marketing preferences and applicable law. If we later engage in activities that qualify as “sale,” “sharing,” targeted advertising, or profiling under applicable privacy laws, we will update this Privacy Policy and provide any required opt-out mechanisms.


9. Global Privacy Control and Opt-Out Preference Signals

Because we do not currently sell personal information or share it for cross-context behavioral advertising, opt-out preference signals such as Global Privacy Control may not affect current data practices. If we later engage in activities that require honoring opt-out preference signals, we will implement an appropriate process and update this Privacy Policy.


10. Marketing Communications

We may send marketing emails if permitted by law and your preferences. You may opt out of marketing emails by using the unsubscribe link in the email or by contacting us at privacy@perpetualbeverages.com.

We may also provide marketing preference settings in your account settings, where available.

If we send text-message marketing, we will do so only with legally required consent, and you will be able to opt out by replying STOP or using other instructions provided in the message.

Even if you opt out of marketing, we may continue to send non-marketing messages, such as account notices, delivery reminders, payment notices, service notices, and legal notices.


11. Retention of Personal Information

We retain personal information only as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, comply with legal obligations, resolve disputes, enforce agreements, maintain security, and support legitimate business needs.

We retain information generally as follows:

  • Account and profile information: for the life of the account and a limited period after closure, such as 90 days, unless a longer period is required or appropriate.
  • Order, delivery, age-verification, signature, and delivery-photo records: for the period required by applicable alcohol, audit, tax, or legal obligations, generally at least three years where required.
  • Date-of-birth (age-gating) data: the date of birth entered at the online age gate is not retained beyond the active session in which it is entered. The separate delivery-time age-verification confirmation is retained as described in the order and delivery records entry above.
  • Payment transaction records: for tax, accounting, dispute, and legal purposes, generally three to seven years depending on the record type and applicable requirement. We do not store full card numbers.
  • Device and consumption telemetry tied to a customer: in identifiable form for the active service period and a short operational period after service ends, after which it is aggregated, de-identified, or deleted.
  • Raw application and diagnostic logs: for a short rolling period, typically 30 to 90 days.
  • Marketing records: until you unsubscribe or request deletion, except that we may retain suppression records as needed to honor opt-outs.
  • Access notes and credentials, such as door codes, gate codes, and entry instructions: retained only as long as reasonably necessary to provide delivery and service, and deleted or updated when no longer current or when service at the location ends.

These periods may vary where required by law, regulation, audit obligations, disputes, safety issues, fraud prevention, or business continuity needs.

After your account is closed or your subscription or replenishment service ends, we delete or de-identify your personal information when it is no longer reasonably necessary, unless we need to retain it for legal, tax, accounting, alcohol-compliance, dispute, fraud-prevention, safety, or equipment-recovery purposes. You may also request deletion at any time, and we will honor verified requests subject to these retention exceptions.


12. Your Privacy Rights

Depending on where you live, and to the extent required by applicable law, you may have rights to:

  • know or access the personal information we collect about you;
  • receive information about the categories of personal information we collect, sources, purposes, and disclosures;
  • request correction of inaccurate personal information;
  • request deletion of personal information;
  • request a portable copy of certain personal information;
  • opt out of sale, sharing, targeted advertising, or certain profiling, if applicable;
  • limit the use or disclosure of sensitive personal information, if applicable;
  • appeal a denial of a privacy request, where required;
  • not be discriminated against for exercising privacy rights.

Because Perpetual Beverages’ current operations may not meet thresholds for some comprehensive state privacy laws, some rights may not apply in all circumstances. We may still choose to honor reasonable privacy requests where feasible and legally appropriate.


13. How to Exercise Privacy Rights

Please include enough information for us to verify your identity and understand your request. We may need to verify your email address, account information, order history, or other information before responding.

We will respond within the time required by applicable law. For California Consumer Privacy Act requests, where applicable, we generally aim to respond within 45 days, subject to permitted extensions.

We may deny or limit a request where permitted by law, including where we must retain information for alcohol, tax, accounting, safety, security, fraud-prevention, dispute, or legal-compliance purposes.


14. Appeals

If applicable law gives you the right to appeal our decision on a privacy request, you may appeal by contacting privacy@perpetualbeverages.com with the subject line “Privacy Appeal.” Please describe the request you submitted and why you believe our response should be reconsidered.


15. Authorized Agents

Where permitted by law, you may designate an authorized agent to submit a privacy request on your behalf. We may require proof of authorization and may also require you to verify your identity directly with us.


16. California Privacy Notice

This section provides additional information for California residents, to the extent the California Consumer Privacy Act and other California privacy laws apply to us.

B. Purposes

We collect and use these categories for the purposes described in Sections 4 and 6 above, including providing the Services, processing payments, fulfilling deliveries, verifying alcohol eligibility, managing equipment, communicating with you, improving the Services, security, fraud prevention, and legal compliance.

C. Categories of Recipients

We may disclose the categories above to the recipients described in Section 6, including service providers, payment processors, hosting providers, communications providers, IoT infrastructure providers, licensed alcohol retailers, delivery/service personnel, and legal or regulatory authorities.

D. Sale or Sharing

We do not currently sell personal information or share personal information for cross-context behavioral advertising. If that changes, we will update this Privacy Policy and provide applicable opt-out rights.

E. Retention

We retain personal information as described in Section 11.

F. California Rights

If applicable, California residents may have the rights described in Section 12, including rights to know, access, delete, correct, opt out of sale or sharing, limit certain uses of sensitive personal information, and not be discriminated against for exercising rights.

California Civil Code Section 1798.83 permits California residents to request certain information regarding our disclosure of personal information to third parties for those third parties' own direct marketing purposes. We do not disclose personal information to third parties for their own direct marketing purposes. California residents may request information about our compliance with this law by contacting us at privacy@perpetualbeverages.com with the subject line "Shine the Light Request." We may require you to provide enough information to verify your identity and California residency. We may respond to such requests as permitted by, and within the time required by, applicable law.


17. Children’s Privacy

The Services are not directed to children under 13. We do not knowingly collect personal information from children under 13.

You must be at least 18 years old to create an account or use the Services. You must be at least 21 years old to order alcoholic beverages. Users under 21 may be restricted to non-alcoholic products where the Services are otherwise available.

18. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. These measures may include encryption, access controls, third-party payment processing, limited payment-card storage, vendor controls, logging, and other security practices.

No method of transmission or storage is completely secure. You are responsible for maintaining the confidentiality of your account credentials and for notifying us promptly if you believe your account has been compromised.


19. International Users

The Services are intended for users in the United States and initially for California service areas. We do not currently state that we target users outside the United States. If you access the Services from outside the United States, you understand that your information may be processed in the United States, where privacy laws may differ from those in your location.

If Perpetual Beverages later targets, monitors, or provides services to users in other countries, this Privacy Policy should be updated for applicable international privacy laws.


20. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The updated version will be posted with a new effective date. If we make material changes, we may provide additional notice, such as by email, in-app notice, or other reasonable means.
